Nesses pedidos, foi oficiada a Governadora do Estado para pagar em trinta dias ou prestar informações e esta não fez nem uma coisa nem outra, em total desrespeito ao Poder Judiciário, apesar de o Estado do Maranhão ter superávit na arrecadação daqueles exercícios.
Entretanto, tanto porque houve descumprimento de decisão judicial pelo não pagamento dos precatórios como porque não informou ao BNDES quanto à inadimplência, o Governo do Estado, temendo ser responsabilizado, bem como perder empréstimo bilionário junto ao BNDES, está se movimentando para dar um calote nos dois principais credores, primeiros na ordem de preferência do recebimento, cujos créditos devidos, juntos, somam mais de 220 milhões.
Todos os precatórios receberam parecer favorável do Ministério Público Estadual em primeiro grau e por duas vezes no Tribunal de Justiça, bem como o Estado do Maranhão foi intimado de todos os atos. Não obstante, o Ministério Público Estadual requereu vista do vultoso precatório de uma instituição financeira nacional, primeira na ordem de pagamento dos precatórios em atraso de 2011, já sinalizando, sem que antes examinasse os autos, que o seu parecer anterior (favorável) estaria equivocado.
Nos bastidores, já se comenta que o interesse é geral (desembargadores, juízes, funcionários do Judiciário, porque também são credores dos precatórios subsequentes) de que os pagamentos desses dois vultosos precatórios sejam de alguma forma retirados da lista, para possibilitar o pagamento dos demais credores.
