A exigência de aprovação prévia em exame da Ordem dos Advogados do Brasil (OAB) para que bacharéis em direito possam exercer a advocacia foi considerada constitucional pelo Plenário do Supremo Tribunal Federal (STF).
Por unanimidade, os ministros negaram provimento ao Recurso Extraordinário (RE 603583) que questionava a obrigatoriedade do exame. Como o recurso teve repercussão geral reconhecida, a decisão nesse processo será aplicada a todos os demais que tenham pedido idêntico.
A votação acompanhou o entendimento do relator, ministro Marco Aurélio, no sentido de que a prova, prevista na Lei 8.906/94 (Estatuto da Advocacia), não viola qualquer dispositivo constitucional. Concluíram desta forma os demais ministros presentes à sessão: Luiz Fux, Dias Toffoli, Cármen Lúcia Antunes Rocha, Ricardo Lewandowski, Ayres Britto, Gilmar Mendes, Celso de Mello e Cezar Peluso.
O recurso foi proposto pelo bacharel João Antonio Volante, que colou grau em 2007, na Universidade Luterana do Brasil (Ulbra), localizada em Canoas, no Rio Grande do Sul. No RE, ele afirmava que o exame para inscrição na OAB seria inconstitucional, contrariando os princípios da dignidade da pessoa humana, da igualdade e do livre exercício das profissões, entre outros.
