O prefeito Zito Rolim (PV) e seu vice, Guilherme Archer (PMDB), tiveram cassados seus diplomas, anulados todos os votos que receberam em outubro de 2012 e ficaram inelegíveis pelos próximos oito anos.
É o que determina a sentença do juiz eleitoral, Pedro Guimarães Junior, que acaba de ser publicada no Fórum Eleitoral de Codó.
Não está relacionada ao caso dos vídeos de compra de votos. Esta sentença diz respeito à uma Investigação Judicial Eleitoral impetrada pelo Ministério Público acusando José Rolim Filho e Guilherme Ceppas Archer de USO INDEVIDO DE MEIOS DE COMUNICAÇÃO SOCIAL, no caso a TV Codó que é pública, ora controlada pela prefeitura.
Também foram sentenciados os apresentadores Jonas Bastos Martins Lopes Filho, Osvaldo Pereira da Silva Filho (Maozinha) e Antonio Leandro Sousa Paiva (Leandro de Sá).
“Alega a representante (Dra. Linda Luz) que o primeiro repsentado, candidato a prefeito desta cidade, estando em plena campanha eleitoral, conforme faz prova documentação anexa, juntamente com os demais representados (Guilherme, Jonas, Osvaldo e Leandro), vem utilizando a TV Codó Canal 13, autorizatária municipal de serviço público, de forma abusiva para beneficiar o mencionado candidato”, relata a sentença explicando a motivação do Ministério Público Eleitoral.
A SENTENÇA
Por conta de tudo que o Ministério Público apresentou de provas contra os cinco acusados os juiz Pedro Guimarães Junior decidiu CASSAR O DIPLOMA DE Zito e Guilherme, ANULAR todos os 23.075 votos que tiveram em outubro e ainda os tornar inelegíveis pelos próximos oito anos.
“Julgo procedente a presente INVESTIGAÇÃO JUDICIAL ELEITORAL para, nos termos do art. 22, inciso XIV, da lei 64/90, CASSAR OS DIPLOMAS DE PREFEITO E DE VICE PREFEITO, expedidos, respectivamente, em favor de José Rolim Filho e Guilherme Ceppas Archer e, via de consequência, ANULAR OS VOTOS DADOS AOS MESMOS no presente pleito, além de declarar a INELEGIBILIDADE destes e dos demais representados Jonas Bastos Martins Lopes Filho, Osvaldo Pereira Filho e Antonio Leandro Sousa Paiva para as eleições a se realizarem nos 8 anos subsequentes à eleição de 2012”, escreveu o juiz
