O procurador-geral de Justiça em exercício, Eduardo Jorge Hiluy Nicolau, solicitou, nesta terça-feira (8), ao procurador-geral da República, Roberto Gurgel, que ajuíze Ação Direta de Inconstitucionalidade (Adin) contra a Emenda Constitucional Nº 064/2011, que aumenta de 70 anos para 75 anos a aposentadoria no serviço público maranhense.
A inconstitucionalidade da Emenda Constitucional, segundo Eduardo Nicolau, decorre do fato de a Assembleia Legislativa ter ampliado a idade de aposentadoria compulsória em descumprimento com a Constituição Federal. A representação assinada por Eduardo Nicolau atende a uma determinação da procuradora-geral de Justiça, Maria de Fátima Rodrigues Travassos Cordeiro.
A mudança de 70 para 75 anos foi aprovada pela Assembleia Legislativa, em 26 de novembro deste ano, com 30 votos a favor e apenas sete contra.
