Um caso de posse de um terreno milionário, envolvendo o dono da Construtora Amorim Coutinho, Eugênio de Sá Coutinho Júnior, e Maria do Rosário Silva Veloso, tem gerado diversos questionamentos.
O processo, que possui como relator o desembargador Antônio Guerreiro Júnior, já tramita na Justiça desde 2007 e diz respeito a reintegração de posse do terreno, que fica localizado na Rua Santo Antônio, no Altoas do Calhau, que pertence à Maria do Rosário que foi ocupado irregularmente pela Construtora.
A reintegração de posse já foi autorizada pela Justiça em fevereiro de 2017.
No decorrer da tramitação, Coutinho alegou que o lote era dele apresentando apenas um título de domínio, chegando a ganhar o processo. Mas a proprietária recorreu da decisão e apresentou documento que comprovou a legítima posse do imóvel.
“Designada audiência de conciliação, realizada em 30 de março de 2007, pelo magistrado presidente do feito foi constatada a forte possibilidade de fraude do documento apresentado pelo requerido ((Eugênio Coutinho Júnior), ou seja, na escritura de compra e venda do imóvel objeto de contenda, lavrada no Cartório do 3º Ofício de Notas, razão pela qual determinou a expedição de ofício a essa serventia extrajudicial para que justificasse a validade do documento. Veio aos autos manifestação dessa serventia.”, diz a peça processual.
O desembargador ratificou a declaração: “Esta Corte Superior já decidiu que, em sede de ação possessória é inviável a discussão a respeito da titularidade do imóvel sob pena de se confundir os institutos, ou seja, discutir a propriedade em ação possessória. Precedentes. (AgRg no REsp 1389622/SE, Rel. Ministro LUIS FELIPE SALOMÃO, QUARTA TURMA, julgado em 18/02/2014, DJe 24/02/2014). Apenas a rescindente apresentou documento que comprova a legítima posse do imóvel, tendo o requerido apresentado apenas título de domínio, cuja veracidade é questionada na própria sentença, de modo que as decisões, assim fundamentadas, constituem violação à disposição literal do art. 927 do CPC/1973.”
Após o despacho, o empresário Coutinho recorreu de todas as decisões e os recursos foram negados. O desembargador mandou oficial de Justiça informar à construtora e dá posse imediata a real proprietária.
